These Terms of Use constitute a legally binding agreement between you (“you” or “the Client”) and Zori Art Photography (“we”, “us”, “our”), governing your access to and use of the website www.zoriart.com and any related pages, domains or subdomains (the “Site”), as well as the photography services offered through it. By accessing this Site, contacting us, or booking photography services, you confirm that you have read, understood, and agreed to be bound by these Terms of Use. If you do not agree with these Terms, please refrain from using the Site or our services. 





Zori Art Photography is a professional portrait photography studio based in Switzerland, offering photography services to private individuals and companies, including but not limited to personal branding photography, business portraits, corporate photography, and related photographic services.





By using this Site or booking our services, you confirm that: you are at least 18 years old, and you have full legal capacity under Swiss law to enter into a binding agreement, either in your own name or on behalf of a company or organisation you validly represent. 





The details of photography services, pricing, scope of work, usage rights, delivery timelines, and any additional conditions are agreed upon individually and may be confirmed via written communication (email, contract, invoice, or booking confirmation). In case of conflict between these Terms of Use and a specific written agreement or contract, the latter shall prevail.





Photography services provided by Zori Art Photography are personalised and scheduled specifically for each client. For this reason, fees paid for photography services are generally non-refundable once a booking has been confirmed. If the Client needs to cancel or reschedule a session, written notice must be provided 24 hours prior to the session scheduled time. Where sufficient notice is given, Zori Art Photography may, at its discretion, offer a rescheduling of the session subject to availability. Any deposits paid secure the date and time of the session and are non-refundable, except where otherwise agreed in writing. The remaining balance, if applicable, is due as specified in the booking confirmation or invoice.
In the event that Zori Art Photography is unable to perform the services due to illness, force majeure, or circumstances beyond reasonable control, the Client will be offered either a rescheduled session or a refund of amounts paid for services not yet delivered. Nothing in this section limits mandatory rights under applicable Swiss law.





All photographs created by Zori Art Photography remain protected by Swiss copyright law. Unless otherwise expressly agreed in writing: Zori Art Photography retains the copyright and authorship of all images. The Client is granted a non-exclusive, non-transferable right to use the delivered images for the purposes agreed upon (e.g. personal use, professional communication, corporate marketing). Images may not be resold, sub-licensed, transferred, or used in a way that is unlawful or defamatory. Any extended usage rights, commercial exploitation, advertising use, or third-party licensing must be agreed upon in advance and may be subject to additional fees.





All content available on the Site, including but not limited to photographs, texts, logos, branding elements, and design, is the intellectual property of Zori Art Photography or licensed accordingly. You may view and browse the Site for personal or professional information purposes only. Any reproduction, copying, distribution, or commercial use without prior written consent is prohibited.





Zori Art Photography processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP / nLPD).

By contacting us or booking services, you agree that we may contact you using the contact details you have provided for purposes related to your enquiry, booking, or service delivery. Marketing communications (such as newsletters or promotional emails) are only sent where you have explicitly opted in. You may withdraw your consent at any time.





The Site may contain links to third-party websites or platforms. Zori Art Photography has no control over and assumes no responsibility for the content, availability, or practices of such third-party sites. Accessing third-party links is done at your own risk.





To the maximum extent permitted by Swiss law: Zori Art Photography shall not be liable for indirect, consequential, or economic damages, including loss of profit or business interruption. Liability is limited to the amount paid by the Client for the relevant photography service. Nothing in these Terms excludes or limits liability for intent or gross negligence, or for any liability that cannot be excluded under mandatory Swiss law.





Zori Art Photography shall not be held liable for delays or failure to perform services due to events beyond reasonable control, including but not limited to illness, accidents, natural disasters, governmental restrictions, or technical failures.





Zori Art Photography reserves the right to amend these Terms of Use at any time. The version in force at the time of your booking or use of the Site shall apply. We encourage you to review these Terms periodically.





These Terms of Use are governed by and construed in accordance with Swiss law. Subject to mandatory consumer protection rules, the courts of Vevey, Canton of Vaud, shall have jurisdiction over any dispute arising from or in connection with these Terms.
